ListingPen is a product of PropKitCo, a brand operated by Byzantine Glam, LLC, a Texas limited liability company. In these Terms, “PropKitCo”, “we”, “us”, and “our” refer to Byzantine Glam, LLC.

1. Acceptance of Terms

By installing or using the ListingPen Chrome Extension (“ListingPen”, “the Extension”, “the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not install or use ListingPen. These Terms form a legally binding contract between you and PropKitCo.

2. Description of Service

ListingPen is a Chrome browser extension that uses artificial intelligence to generate marketing content from real estate listing pages. When you visit a supported listing site (such as Zillow, Realtor.com, Redfin, or MLS systems), ListingPen can extract property details and generate:

Professional MLS-style listing descriptions
Social media captions with hashtags
Email pitches for buyer's agents

ListingPen is intended for use by licensed real estate professionals as a tool to assist with marketing copy creation. It is not a substitute for human review or legal compliance with MLS rules.

3. Account Registration

To use ListingPen, you must create an account using a valid email address and password (or a Google account). You agree to:

Provide accurate, current information during registration
Maintain the security of your password
Notify us immediately of any unauthorized access
Be responsible for all activity that occurs under your account
Be at least 18 years of age

4. Pricing and Subscription

ListingPen offers the following pricing tiers:

Free Tier: 3 AI generations per calendar month at no cost. Resets on the 1st of each month.
Pro Monthly: $7 USD per month, billed monthly via Stripe through ExtensionPay. Unlimited generations, all tones, and all length options.
Pro Lifetime: $49 USD one-time payment for lifetime access. Unlimited generations, all tones, and all length options. No recurring charges.

Prices are subject to change with 30 days' notice. Existing subscribers will continue at their current price until they cancel or change plans.

5. Billing and Payment

Subscriptions automatically renew at the end of each billing period unless canceled
You can cancel anytime through ExtensionPay's customer portal or by contacting us
Cancellations take effect at the end of the current billing period
Lifetime purchases are one-time and do not auto-renew
All payments are processed in USD
You are responsible for any applicable taxes

6. EEA Consumer Rights (Right of Withdrawal)

If you are a consumer located in the European Economic Area (EEA), you have a 14-day right of withdrawal under EU Directive 2011/83/EU.

Important: By starting to use ListingPen (e.g., generating your first AI output), you expressly consent to immediate provision of digital content and acknowledge that you lose your right of withdrawal once digital content is delivered. This is in accordance with Article 16(m) of Directive 2011/83/EU.

Refunds: If you have not used any AI generations, contact us within 14 days of purchase for a full refund. Contact areakitpro@gmail.com.

7. Acceptable Use

You agree NOT to use ListingPen to:

Generate false, misleading, or deceptive listing content
Violate fair housing laws or any anti-discrimination regulations
Generate content that misrepresents property features or condition
Resell, redistribute, or commercialize the AI generation service itself
Reverse engineer, decompile, or attempt to extract source code
Use automated scripts or bots to abuse the service
Share your account credentials with others
Bypass usage limits or attempt to access Pro features without payment
Use the service for any unlawful purpose

Violations may result in immediate account termination without refund.

8. AI-Generated Content Disclaimer

ListingPen uses third-party AI models to generate text. You are solely responsible for reviewing and editing all AI-generated content before using it in any official capacity. We make no warranty that:

Generated content is accurate, complete, or factually correct
Generated content complies with MLS rules in your area
Generated content complies with fair housing or advertising laws
Generated content is unique or non-infringing

You retain full ownership of property data you input and the AI outputs you generate. We do not claim copyright over generated text. However, AI outputs may not be eligible for copyright protection under current U.S. law.

Always verify property details independently before publishing any listing materials.

9. Intellectual Property

ListingPen, including its source code, design, branding, and trademarks, is owned by Byzantine Glam, LLC. You may not copy, modify, distribute, or create derivative works of the Extension without written permission.

10. Service Availability

We strive to provide a reliable service but make no guarantee of 100% uptime. Scheduled maintenance, third-party outages (Supabase, Anthropic, Stripe), or browser changes may temporarily interrupt service. We are not liable for losses arising from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Byzantine Glam, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of ListingPen.

Our total liability for any claim related to ListingPen shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Nothing in these Terms limits your statutory consumer rights under EEA or other applicable law where such limits are not permitted.

12. Termination

You may stop using ListingPen at any time by uninstalling the extension and/or deleting your account. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ends immediately, and you remain responsible for any unpaid charges.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 30 days before they take effect. Your continued use of ListingPen after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts of the State of Texas.

EEA consumers retain the right to bring claims in their country of residence under applicable EU law.
